What is a visa?

The U.S. Immigration and Naturalization laws and regulations are extremely dynamic. Since 1990, numerous changes have been made to the laws that appear to favor highly-skilled labor in the United States. Legislation has made it possible for employers in the United States to take advantage of what some have called the world-wide "brain-drain". While other immigration categories exist for unskilled workers and for family-based immigration, those categories may require significant waiting periods before work authorization and/or visas may become available.

This guide serves as an introduction to the general concepts of immigration law. The general principles in this guide cannot, and should not, be substituted for a thorough analysis of then-current relevant statutes, regulations, and (if and when appropriate) certain ancillary resource documents that are available to assist the attorney in his/her advice to the client.

One of the most important concepts to be conveyed by these materials and a concept that should be instilled in any Immigration and Naturalization practice is that any and all immigration options for each client should be explored thoroughly. The belief that any one particular immigration category is the only way to acquire immigration status in the United States would be to view a client’s immigration problem "wearing blinders."

This guide has been divided into four (4) separate parts. The first section discusses the nonimmigrant visa categories. The second section discusses the employment-based visa preferences. The third section discusses family-based immigration options. The fourth section discusses other immigration visa options that do not fall within the previously discussed categories.
